Wright is wrong when it comes to updating brokers

In the news item headlined 'Claims cases can drag on for two years' (Mortgage Strategy August 31) Carl Wright, director of Cartel Client Review, states that "with anyone but the client, solicitors are bound by Law Society rules and can't discuss [a financial claims case] so the broker will not be updated. Once a broker has introduced a client, their involvement in the case is over". I'm afraid Wright is wrong. Solicitors can discuss clients' cases with third parties provided they have a client's permission.

Brokers play a pivotal role in ensuring lenders, estate agents, solicitors, valuers, insurers and others are all making good progress with cases and it would be nonsense to deny brokers access to information which allows them to keep their clients updated.

An illustration of this is panel arrangements in which some lenders do not allow solicitors to talk to introducing brokers.

This often leads to delays and frustrations that could easily be avoided because brokers want to work with lawyers to ensure the smooth and efficient handling of cases through to completion.

We always obtain written permission from clients allowing us to provide brokers - which included Cartel in its remortgaging days - with regular progress reports via our online portal GW Live.

Brokers consider this information to be essential and, provided the appropriate client authorisation has been obtained, neither the Law Society nor the Solicitors Regulation Authority will prevent solicitors from keeping brokers updated.

There is no sensible reason for brokers to be kept in the dark.
