Ruling will allow Cartel to proceed with stalled cases

Some 100,000 claims cases waiting to be settled by Cartel Client Review could be pushed through after the firm won what it calls a landmark court case last week.

Carl Wright, managing director of Cartel, working with law firm Consumer Credit Litigation Solicitors, won a case against credit card provider MBNA.

It proved the existence of an unfair relationship between a Cartel client and MBNA because of the way she had been sold payment protection insurance, so the client did not have to pay the company back the £8,000 that she owed on her credit card.

Wright says that although his firm has settled and litigated more than 4,000 cases it still has more than 60,000 in progress and a further 100,000 that were awaiting such a ruling before progressing.

Wright says: "We can now move from settling out of court to putting our foot on the gas and doing huge volumes of business."

The Financial Services Authority issued guidelines for firms selling PPI last week which require them to reopen some 185,000 rejected PPI complaints and reassess them.

But the Association of Mortgage Intermediaries and the Association of Finance Brokers have hit out at the new guidance.

Robert Sinclair, director of AMI and AFB, says: "Companies are being asked to address all complaints in the same way irrespective of when the sale was made, with the review period covering two major regulatory changes.

"We have always argued against the application of today's standards to yesterday's work and will continue to campaign on this."
